These Terms & Conditions govern the purchase of products and services from Pergola or Carport. By accessing our website or placing an order, you agree to these Terms.

1. Orders & Products

1.1 Website listings do not constitute a binding offer to sell. Orders are subject to acceptance and availability.

1.2 All measurements and specifications are approximate.

1.3 Many products require assembly or professional installation. Customers are responsible for reviewing requirements before purchase and ensuring they have a suitable site.

1.4 Product images are for illustration purposes and may vary slightly.

2. Pricing & Payment

2.1 Prices are in AUD and include GST where applicable, unless stated otherwise.

2.2 Delivery charges may apply for regional, remote, or island locations.

2.3 We may correct pricing errors and cancel orders with a full refund if necessary.

2.4 Payment must be made in full at checkout unless agreed otherwise.

2.5 Ownership of goods remains with Pergola or Carport until payment is received in full.

3. Shipping & Delivery

3.1 We deliver to New South Wales-wide; extra freight charges may apply to certain areas.

3.2 Delivery timeframes are estimates only. Delays may occur due to supplier issues, transport disruptions, port congestion, customs processing, or international freight schedule changes.

3.3 All shipments are subject to international freight schedules. Pergola or Carport is not responsible for delays caused by international shipping or freight carriers.

3.4 International freight delays alone do not entitle cancellation or refund unless required under Australian Consumer Law.

3.5 Customers must provide accurate delivery information. We are not liable for failed deliveries due to incorrect details.

3.6 Risk of loss or damage passes to the Customer upon delivery.

3.7 Products must be inspected within 7 days of delivery and any issues reported promptly.

4. Installation Services

4.1 Where installation services are purchased, installation will be scheduled after the product has been delivered, subject to installer availability and weather conditions.

4.2 Installation timeframes vary depending on product type, site access, and complexity. Installation may take between 1 and 5 days.

4.3 Customers must ensure the installation area is accessible, clear, and safe before installers arrive. Delays caused by site inaccessibility may result in additional charges.

4.4 Standard installation pricing assumes suitable existing flat surfaces and structures. If adjustments or additional materials are required to prepare the site for safe installation, additional charges will apply. These may include (but are not limited to):

Concrete cutting, drilling, or slab modification

Footing reinforcement, extension, or new footings

Wall anchoring modifications

Structural supports or levelling work

Additional brackets, plates, fasteners, or reinforcement materials

Site preparation materials necessary to meet structural or safety requirements

Any additional work required will be quoted to the Customer before proceeding where reasonably possible.

4.5 Pergola or Carport is not responsible for hidden services (such as plumbing, electrical wiring, or drainage) unless previously disclosed.

4.6 Installation dates provided are estimates only. Pergola or Carport is not liable for delays caused by weather, site conditions, material shortages, or installer availability.

4.7 The total purchase price includes a standard installation fee ranging from AUD $900 to $1,500, depending on the pergola or carport size and standard installation requirements. This fee covers installation under normal site conditions only and does not include site preparation or additional materials as described in Clause 4.4.

4.8 If Pergola or Carport is unable to provide installation services due to no installers being available in the Customer’s area within a reasonable timeframe, the installation portion of the fee may be refunded at our discretion. This does not affect the product sale itself.

5. Refunds, Returns & Cancellations

5.1 Unavailable Products – Full refund if no alternative is accepted.

5.2 Damaged or Faulty Products – Repair, replacement, or refund in accordance with Australian Consumer Law. Replacement parts may be supplied instead of a refund where appropriate.

5.3 Change of Mind – No change-of-mind refunds after dispatch. A 30% cancellation fee may apply to packed orders cancelled before dispatch.

5.4 Extended Delivery Delays – If delivery exceeds 95 days, you may request a refund or accept a 5% discount for waiting.

5.5 Returns – Approved returns must be repackaged securely. Refunds are processed after inspection.

5.6 Collections – Failed collections may incur a wasted journey fee.

6. Warranty

6.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

6.2 Additional manufacturer warranties may apply but do not cover improper installation, misuse, modifications, normal wear, or extreme weather beyond design limits.

7. Limitation of Liability

To the maximum extent permitted by law, Pergola or Carport is not liable for indirect or consequential losses. This does not exclude your rights under Australian Consumer Law.

8. Privacy

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

We are not liable for delays caused by events beyond our control, including natural disasters, extreme weather, supplier failures, or freight disruptions.
